Terms & Conditions
The following terms & conditions apply between Offroad Routes and Tours (“the Operator”) and all individuals (“the participants”) referred to on the Tour Booking Form to which this document is annexed.
➢ A deposit of 50% of the total tour value is due at the time of registration, to secure booking.
➢ Balance payable 6 weeks (42 calendar days) before the tour date.
➢ Rates for children younger than 12 are available on request. Adult rates apply to children 12 years and older.
➢ Tour costs are subject to change due to exchange rate fluctuations, where applicable.
➢ Cancellation/Refund: If the client wishes to cancel a confirmed booking, the client must notify the Operator in writing. The following cancellation charges apply notwithstanding any payments that have been made:
• Cancellations 120 to 63 calendar days before departure: 30% of total tour value.
• Cancellations 62 to 42 calendar days before departure: 50% of total tour value.
• Cancellations less than 42 calendar days before departure will forfeit 100% of the amount paid.
➢ The Operator reserves the right to change itineraries in its sole discretion depending on the availability and size of the group.
➢ VHF radios are compulsory on all 4×4 tours and can be hired from the Operator.
➢ No disorderly or unruly behaviour will be tolerated on the Operator’s tours. In this regard, the Operator reserves its right to summarily terminate further involvement in a tour of any disorderly or unruly participant and their company, the costs of which shall be borne by such disorderly or unruly participant.
➢ No generators will be allowed on any of the Operator’s tours.
➢ All vehicles must be equipped with the necessary recovery equipment and the onus rests on the driver to fully acquaint himself/herself with the required equipment.
➢ While traveling in remote areas, the guides will make every effort to create a safe and fun environment for all participants and their company.
➢ No littering is allowed and all litter is to be transported out of the wilderness areas. The onus rests on the driver, who must inform his/her company that there are no dustbins in most of the wilderness areas visited.
➢ Cross-border and medical insurance are compulsory on all of the Operator’s tours. Should any participant not have cross-border insurance, the Operator can assist with recommendations and obtaining the correct insurance.
➢ In the event that a tour is cancelled by the Operator, all deposits and other monies paid by the participant will be promptly refunded.
➢ The Operator, its agents, and assigns will not be held responsible for any delays, substitution of equipment or any act or omission whatsoever by the carrier, its agents, servants, and employees, and the participant hereby waives any claim arising therefrom.
➢ This agreement shall be governed by the laws of the Republic of South Africa. Any dispute of any nature whatsoever arising herefrom shall first be referred to alternative dispute resolution (“ADR”).
➢ Should any party be aggrieved by the outcome of such ADR process, they shall have the right to approach the courts.
➢ By participating in a tour, you give consent that the Operator and its agents may take photos of you and your company whilst participating in the tour or any activity and that the Operator may use this in promotional material.
